The year's most anticipated crypto market structure bill fell short of the 60 votes needed on Sep 15. The focus now shifts to regulators, the SEC and the CFTC.

On Sep 15, 2026, the U.S. Senate held a procedural vote on the Digital Asset Market Clarity Act (CLARITY Act) that ended 49–50, far short of the 60 votes needed for the bill to advance.
What is the CLARITY Act?
- The bill aims to define how each type of crypto asset and blockchain project is regulated, including giving the CFTC new authority over spot crypto markets.
- It is seen as the most comprehensive legal framework for the U.S. crypto market to date.
Why did it fail?
- The compromise text ran to more than 600 pages but did not resolve the ethics provisions, in particular limits on senior officials' crypto business ties.
- Political pressure ahead of the Nov 3 midterm elections led even some Republican senators to vote against it.
What comes next?
- The crypto industry is turning its attention to the regulators. The SEC has just proposed a Regulation Crypto Assets package on fundraising channels, and the SEC and CFTC are also drafting their own rules.
- SEC Chair Paul Atkins acknowledged that these rules will lack durability without legislation from Congress behind them.
- According to DeFi Rate, the odds of the bill passing this year are now only about 7–9%.
What it means for investors
- The U.S. legal framework will remain unclear in the short term. This is a risk factor to weigh, especially for altcoins that could be deemed securities.
